Joseph Curl

Joseph Curl Joseph was called to the Bar in 2007. He joined 9 Stone Buildings in October 2008 following completion of his pupillage in these Chambers.

He has a broad practice comprising general civil litigation alongside traditional and commercial Chancery work. Joseph undertakes drafting, advisory and court work in the following areas:
  • Personal and corporate insolvency
  • Company and contractual disputes
  • Real property
  • Landlord and tenant
  • Professional negligence
  • Professional discipline and regulation
  • Wills and probate
As well as routinely undertaking trials in the County Court and the High Court, Joseph has appeared a number of times in the Court of Appeal. He has also appeared in the Solicitors Disciplinary Tribunal, Leasehold Valuation Tribunal and Social Security Appeals Tribunal.

Joseph has been published in Insolvency Intelligence, International Corporate Rescue and Trust Quarterly Review and is a standing contributor to Wills and Trusts Law Reports. He is a student member of the Society of Trust and Estate Practitioners and has sat and passed a number of STEP's professional examinations.

He is also a tutor in Equity & Trusts at the University of London.

Between 2001 and 2007, Joseph worked full-time in the insolvency department of DLA Piper UK LLP while carrying out both his BA and LLB degrees by part-time evening study.

Varsani v Relfo Limited (in liquidation)

Led by Guy Newey QC (now Mr Justice Newey) and Peter Shaw in this cross-border claim by a liquidator to recovered monies paid away in breach of trust. The Court of Appeal's decision concerned the correct interpretation of "usual or last known residence" for the purposes of the revised CPR Rule 6.9.

Parkinson Engineering Services PLC (in liquidation) v Swan
[2010] Bus LR 857, [2010] BPIR 437, [2010] PNLR 17, [2010] 1 BCLC 163, The Times 13 January 2010, [2009] All ER (D) 232 (Dec)
Led by Peter Shaw in this Court of Appeal decision concerning whether a negligence claim against administrators should be amended where the limitation period had expired.

Terry New v Gromore Limited
[2010] 1 P & CR D50, [2009] All ER (D) 81 (Nov)
Trespass to land and wrongful interference claim arising from the unauthorised demolition of a distinguished sculptor's premises containing valuable works of art.

Louise Penfold v Tommy Fuller
[2009] All ER (D) 312 (Oct)
Determined the correct interpretation of "the claimant" for the purposes of the Civil Proceedings Fees Order 2008 and CPR rule 3.7.

Coke-Wallis v Institute of Chartered Accountants in England and Wales
[2009] CP Rep 46, [2009] All ER (D) 147 (Jul), [2008] All ER (D) 73 (Nov)
Court of Appeal decision about a professional regulator's internal disciplinary proceedings. Dealt with autrefois acquit, res judicata, legitimate expectation and abuse of process. How these doctrines relate to professional discipline and regulation. Appeal in the Supreme Court listed to be heard in November 2010.
