Jonathan Lewis JONATHAN LEWIS LL.B.(Hons) (Manchester)

Jonathan Lewis was called to the bar in 1996.

Practice

Jonathan has a Commercial and Chancery practice with a particular emphasis on corporate and personal insolvency. He regularly acts for liquidators, receivers, administrators and for trustees in bankruptcy.

Jonathan has also developed a busy practice in construction and engineering disputes. These disputes have been conducted in litigation (in the Technology and Construction Court), arbitration and adjudication. The value of the disputes in which he has been involved has ranged between £200,000 and £4.6 million. He acts regularly for substantial Registered Social Landlords in construction disputes both in adjudication and in the Technology and Construction Court.

Jonathan also has experience of a wide range of construction related commercial work including insolvency of contractors and employers and bonds and guarantees. Jonathan has also acted and advised in a number of professional negligence actions against construction professionals including architects, contract administrators and employer's agents.

Recent cases of note include:
  • X-Section Limited v Celsius Energy Control Limited (2007) (TCC) HHJ Jackson QC. Successfully resisted application to stay the execution of a Judgment based on an Adjudicator's decision. Concerned questions of solvency and material deterioration in financial position of the respondent.
  • Humes Building Contracts Limited v Charlotte Homes Surrey Limited (2007) (TCC) HHJ Gilliand QC- Lawtel 4 January 2007 and see article in Building Magazine 27th April 2007. Successfully resisted enforcement of an Adjudicator's decision on the grounds of a breach of natural justice.
  • Ujima Housing Association Limited v Building Principles Limited and Walter Parker (2006) (Ch.D.) Briggs J. Successfully obtained an order for costs against a non-party director who improperly caused a company controlled by him to issue a statutory demand.
  • Building Principles Limited v Ujima Housing Association Limited (2006)- Acted for Ujima in a four month adjudication in a construction dispute. Successfully resisted a claim for £2.3million in damages for alleged unlawful termination of a construction contract.
  • Andrews v Bohm and another [2005] All ER (D) 161, Mann J. Successfully persuaded the Court that it had jurisdiction under the Insolvency Rules to dispense with service of a bankruptcy petition.
  • Re Palmiero [1999] 3 EGLR 27. Landlord and Tenant, landlords right to retain tenant's fixtures upon forfeiture.
  • Jay Benning Peltz (a Firm) v Brian Deutsch [2001] BPIR 510 (Ch), Neuberger J. Appeal concerned the connection between the CPR and Insolvency Rules and the way in which a court should exercise its power to make an order of its own motion.
Lecturing activities

Jonathan has frequently lectured on a number of practice related topics both as part of the 9 Stone Buildings lecture series and in-house to solicitors and professional lay clients.

After his year at the Inns of Court School of Law, he was invited to return as a part-time tutor, which he did for a year.
