Rory Brown led by Jeff Chapman QC (instructed by Brandsmiths) represented the Claimant at trial in the utilities dispute: Green Deal Marketing Southern Ltd (“GDM”) v. Economy Energy Trading Ltd (“EE” ) [2019] EWHC 507 (ChD.). HHJ Keyser QC, after handing down a careful and substantial reserved judgment awarded GDM compensation of £1,049,600 under the Regulations. This award appears to be the highest ever made under the Regulations. The Judge held that EE wrongfully terminated its contract with GDM; that the Commercial Agents Regulation 1993 applied to the relationship (in part because electricity constituted “goods” for those purposes).
