In this case, Edward successfully appealed a decision made by a judge under section 84(2) of the Law of Property Act 1925 on the operation of a restrictive covenant not to cause nuisance or annoyance. Edward persuaded the Court of Appeal that activities that took place off the burdened land (the public highway) could not constitute a breach of such a covenant.
