Thomas Cockburn


Tom joined 9 Stone Buildings in October 2017 on successful completion of his pupillage in chambers. He has a broad commercial and chancery practice and accepts instructions in all core areas of chambers’ practice. He has gained particular experience in the following areas.

Tom has represented landlords and tenants in possession and forfeiture proceedings, and has also appeared in housing disputes. He has assisted in cases involving dilapidations, construction disputes, boundary and easement disputes, trusts, and nuisance claims.

Tom has appeared before the County Court and High Court in various insolvency (both corporate and personal) hearings. He has also assisted in cases involving: applications to set aside statutory demands; an injunction to restrain the presentation of a winding up petition; an application for permission to bring proceedings against office-holders after their discharge from liability; an application for the High Court to assist insolvency proceedings in the BVI; and transactions at undervalue claims.

Probate & Trusts
Tom has assisted in applications to remove and substitute executors, Beddoe applications, claims under the Inheritance (Provision for Family and Dependants) Act 1975, and claims disputing the validity of wills. He has been involved in several mediations of contentious probate matters in which settlements have been reached. His experience also includes disputes involving commercial and offshore trusts, such as assisting in an application to remove trustees from office where the substantial trust was key to the struggle for control of a prominent Italian ceramics company.

Tom has acted in his own right in a number of commercial disputes involving claims for breaches of contract. He has also assisted in several civil fraud claims and gained experience of obtaining injunctive relief in the course of commercial litigation, in particular freezing injunctions and anti-suit injunctions.

Before joining the Bar, Tom qualified as a probation officer in which role he worked with offenders in custody and the community and represented the probation service in the Crown Court and the Court of Appeal, Criminal Division.
